2. Scope
These Terms govern your access to and use of petbase.ai, our apps, and related services. By creating an account or using the service, you accept these Terms and our Privacy Policy.
3. Accounts and eligibility
- You must be at least 18 and have authority to bind your company if you use the service for business.
- Keep your credentials confidential - you are responsible for activity under your account.
- We may suspend or terminate accounts for misuse or non-payment.
4. Acceptable use
Do not:
- Break the law, violate rights, or upload illegal, harmful, infringing, or personal data without a lawful basis.
- Probe, scan, or overload the service, bypass security, reverse engineer, or remove notices.
- Use bots or scraping except as permitted by documented APIs.
- Introduce malware or attempt to access other users’ data.
5. Plans, fees, and payment
- Some features may be paid. Prices and plan limits are shown in the product checkout or pricing page.
- We may change prices with at least 30 days’ notice before the next term. You can cancel before the change takes effect.
- Fees and Refunds
- All payments for petbase.ai are processed by Paddle, our Merchant of Record. Customers have a 14-day right to cancel the purchase and request a refund from Paddle, in accordance with Paddle’s Consumer Terms: https://www.paddle.com/legal/invoiced-consumer-terms. Refunds are managed exclusively by Paddle. No additional exceptions or limitations apply beyond Paddle’s policy.
- Refund Policy
- Paddle is the Merchant of Record for all transactions. Customers can request a refund within 14 days from the date of purchase by contacting Paddle directly via the instructions in the purchase receipt or at https://paddle.net.
Exception: If the customer chooses to start using the digital service immediately and explicitly agrees to immediate performance, the 14-day cancellation right ends once digital delivery begins, as defined in Paddle’s Consumer Terms.
Paddle administers all refunds and will determine eligibility under their policy.
6. Intellectual property
- We retain all rights in the service and its content.
- You retain rights to your content and grant us a non-exclusive license to host, process, and display it to provide the service.
- You must have the rights to the content you upload.
7. Third-party services
The service may integrate third-party tools. Their use is governed by those providers’ terms and privacy policies. We are not responsible for third-party services.
8. Privacy and data protection
- We process personal data as described in our Privacy Policy.
- If we process personal data on your behalf, our Data Processing Agreement applies.
- You are responsible for having a lawful basis for personal data you submit to the service.
9. Service changes and availability
We may improve, update, or modify the service. We aim for high availability but do not guarantee uninterrupted operation. Planned maintenance and incidents may cause downtime.
10. Warranties
The service is provided “as is” and “as available.” We disclaim all implied warranties to the fullest extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement.
11. Liability
- We are not liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, revenue, data, or business.
- Our aggregate liability for all claims is limited to the fees you paid to us for the service in the 3 months before the event giving rise to the claim.
- Nothing limits liability that cannot be limited by law.
12. Indemnity
You will indemnify and hold us harmless from third-party claims arising from your content, your unlawful use of the service, or your breach of these Terms.
13. Term and termination
- These Terms apply from signup or first use. Subscriptions renew per their billing cycle.
- You may cancel at any time effective at the end of the current paid term.
- We may suspend or terminate for material breach, legal risk, or non-payment. After termination your access ends and we may delete data per our retention policy.
14. Consumer information
- If you are a consumer in the EU and purchase digital services that start immediately, your statutory withdrawal right may not apply once performance begins with your express consent. Your mandatory consumer rights remain unaffected.
- All purchases are processed by Paddle as the Merchant of Record, and Paddle’s Consumer Terms apply to all refund rights.
15. Governing law and venue
German law applies, excluding its conflict-of-laws rules and excluding the UN Convention on Contracts for the International Sale of Goods. Courts in Hamburg, Germany have exclusive jurisdiction, and for consumers the mandatory venue rules of your residence apply.
16. Changes to these Terms
We may update these Terms. If changes are material, we will notify you in advance. Continued use after the effective date means you accept the changes.
